Arbitrage is een alternatieve vorm van geschillenbeslechting. Partijen kiezen bewust voor arbitrage wanneer zij behoefte hebben aan meer regie over de procesgang. Besluitvorming vindt plaats door inhoudelijk deskundige arbiters, gekozen door de partijen zelf. Hierdoor sluit de behandeling van het geschil beter aan bij de specifieke aard en complexiteit van de zaak. Een belangrijk voordeel van arbitrage is de vertrouwelijkheid. In tegenstelling tot procedures bij de civiele rechter vindt arbitrage doorgaans buiten de openbaarheid plaats. Dit maakt arbitrage bij uitstek geschikt voor commerciële geschillen waarbij reputatie, bedrijfsgevoelige informatie of strategische belangen een rol spelen. Daarnaast biedt arbitrage vaak flexibiliteit in procedurele inrichting, snelheid van behandeling. In geval van (internationale) geschillen en overeenkomsten is de keuze voor arbitrage veelal zelfs welhaast een must, nu uitspraken van Nederlandse rechtbanken doorgaans niet afdwingbaar zijn in landen buiten Europa maar wel op grond van het Verdrag van New York.

Wij adviseren cliënten ook bij het opstellen en beoordelen van arbitragebedingen, de keuze voor institutionele of ad-hoc arbitrage en de strategische afweging tussen arbitrage en procederen bij de civiele rechter. Indien nodig begeleiden wij cliënten daarnaast bij procedures rondom de erkenning, tenuitvoerlegging of vernietiging van arbitrale vonnissen.

An alternative form of dispute resolution, arbitration is an option that parties deliberately choose when they want to have more control over the proceedings. Decisions are made by arbitrators who are also subject-matter experts and who are chosen by the parties themselves, ensuring that the dispute is handled more effectively in view of the specific nature and complexity of the case. A key advantage of arbitration is its confidentiality. Unlike civil court proceedings, arbitration proceedings are usually not public. This makes arbitration ideally suited to commercial disputes in which reputation, company-sensitive information or strategic interests need to be considered, while it also generally offers flexibility in the structure of the proceedings and speed of handling.
