From overdrafts to factoring, from a private loan to crowdfunding, there are many different forms of financing to choose from. Taking on or providing financing is no simple matter. There are many laws and regulations and there is even more fine print. Our financial lawyers can advise on the preparation of financing documentation, for either the lender or the borrower, in the case of new financing or refinancing. They can also assist you in demanding payment of a loan that has been granted or enforcing security, such as a pledge or mortgage.
Financial institutions such as banks, brokers, insurers and asset managers, and also intermediaries, are subject to a special duty of care. Sometimes the financial institution may tend to test and exceed the limits of service, for example by not providing enough information or unilaterally changing terms and conditions. This could lead to liability on the part of the financial institution or intermediary. A bank may also terminate the credit relationship, with dire consequences.
